SALES POLICY AND TERMS
Placing an order with Montague Latch Company constitutes acceptance of all of the following:
PAYMENT TERMS: Subject to credit approval, net 30 days. We accept the following credit cards: Visa, MasterCard, and American Express. We will ship C.O.D. when proper credit information is not available, in order to avoid delay of shipment. Accounts are payable in U.S. Funds only.
PRICING: Prices are based on quantities for each individual product. No combination or further discounts are available. Prices are subject to change without notice. Please call, e-mail, or fax for a quote.
SMALL ORDER FEE: Orders for less than $40.00, not including shipping or freight charges, are subject to a small order fee.
BLANKET ORDERS: Blanket orders must be shipped complete within one calendar year from date of order.
ORDER CANCELLATION: We reserve the right to apply a minimum cancellation fee of 15% to all canceled orders.
SHIPPING: Shipments are made F.O.B. our plant in Clio, Michigan. All parcel shipments carry parcel insurance. We are committed to shipping all orders on time; however, we cannot be held responsible for delays due to causes beyond our control. Items not shipped will be backordered and shipped once available. Without specific shipping instructions, we will attempt to select the most efficient carrier, but cannot be responsible for delays or expense.
SHORTAGES: All claims for shortages must be filed within 10 days from customer's receipt of shipment and all claims for any given shipment must be made at one time. All shipments leaving our plant are shipped in a safe and secure manner. We are not responsible for loss or damage during transit. Any claims for losses must be made with the carrier.
RETURNED GOODS: A minimum restocking fee of 15% will be charged on any products returned in their original condition. Returns will not be accepted without prior approval. Returns are not allowed on custom cable assemblies, or on special, modified, or non-standard latch assemblies or components. Returns will not be accepted after 60 days from date of invoice. In the unlikely event that a defect is claimed, we will replace such item after it has been returned to us for examination and the defect is verified. In no event shall liability extend beyond the replacement cost of the item.
CUSTOM DESIGNS: We reserve the right to market and sell any product in which we are in any way involved in either the design, or the manufacturing, whether in part, or in whole.
LIMITED WARRANTY: Seller makes no warranties of any kind, expressed or implied, except that the goods sold by Seller shall be of Seller’s standard quality. In the event Buyer believes the goods sold by Seller do not meet Seller’s standard quality, the sole and exclusive remedies of Buyer shall be, upon verification by Seller and in the sole discretion of Seller, repair or replacement of the goods. Seller has no control over the Buyer or ultimate user’s application of Seller’s product. Seller shall have no liability for consequential or incidental damages under any and every circumstance. Seller makes no other warranties, whether written or oral, expressed or implied, with respect to items manufactured or supplied by Seller, including any implied warranties of merchantability or fitness for any particular purpose.
